Pixelbooking Licensing Agreements

How are you going to use the products you buy from Pixelbooking?

The answer to that question will determine the license you need to buy. Check out the descriptions below to find the license that fits your needs. You must buy the appropriate license for each product you wish to purchase. Thanks for pixelbooking with us and we welcome any questions you have.

Personal License User Agreement

We hereby grant to you a perpetual, non-exclusive, non-transferable worldwide license to use the Copyrighted Products for the Permitted Uses (as defined below).

All images and Downloadable Pixelbooking Digital Products (referred to as "Copyrighted Products") belong to Pixelbooking, Inc. and are copyrighted. Pixelbooking retains all copyrights to the products and grants you a "license" to use our products.

Unless the activity or use is a Permitted Use, you cannot do it. All other rights in and to the Copyrighted Products, including, without limitation, all copyright and other intellectual property rights relating to the Copyrighted Products, are retained by Pixelbooking, Inc.

Violation of this license agreement is considered stealing intellectual property, which is illegal and punishable by law. Use of any of the Copyrighted Products, in any form, on any tangible or electronic form for business promotion or professional use is strictly prohibited and will be prosecuted by law.

(1) WHAT YOU CAN DO.

By purchasing a Personal License for each downloadable product, you are granted the following uses of these products:

1. You may only use the Copyrighted Products for those specified purposes which are Permitted Uses (as defined below). ANY USE OF THE COPYRIGHTED PRODUCTS THAT IS NOT A PERMITTED USE SHALL CONSTITUTE INFRINGEMENT OF COPYRIGHT.
2. Only you are permitted to use the Copyrighted Products, You may install and use the Copyrighted Products in only one location at a time, although subject to the Prohibited Uses and the other terms of this Agreement, you are entitled to utilize the Permitted Uses an unlimited number of times. You may physically transfer the Copyrighted Products and its archives from one location to another, in which case you may use the Copyrighted Products at the new location instead. You may make one (1) copy of the Copyrighted Products solely for back-up purposes, and you must reproduce all proprietary notices on this single back-up copy.
3. You may show your completed flattened layouts to anyone (includes displaying on the Internet, blogs, social media, emailing, printing and distribution).
4. You may create baby announcements, shower invitations, or other greeting cards and email them or print & mail them to others (flatten your layouts first). You must give credit for the graphics as follows: © Pixelbooking, Inc. www.pixelbooking.com
5. You may print graphics for hybrid or paper scrapbooking for your own personal use (as long as you don't share printed copies or digital files with others).
6. You may resize, recolor or add other graphics to the Copyrighted Products for your personal use.
7. You may use Copyrighted Products in scrapbooking layouts that you are submitting to Scrapbook or Craft related magazines for publication only if proper credit is given to: Pixelbooking, Inc. and www.Pixelbooking.com like this: Pixelbooking.com, Kit Name and element. (This includes any starting point of any graphic of the Copyrighted Products.)
8. Any other use must be approved in writing by Pixelbooking, Inc. at 4960 S. Gilbert Rd. Ste 1-217, Chandler, AZ 85249 or info@pixelbooking.com.

(2) HERE’S WHAT YOU CANNOT DO (Prohibited Uses):

1. Prohibited Uses are defined as doing anything with the Copyrighted Products that is not expressly permitted in the preceding section. For greater certainty, the following are “Prohibited Uses” and not limited to the following:
2. Do not burn a CD or make a copy of the graphics and give to a friend, relative, co-worker or anyone.
3. Do not share files with a friend, relative, co-worker or anyone.
4. Do not email individual graphics to a friend, relative, co-worker or anyone.
5. Do not post graphics on the Internet for download (you can only show your completed layouts).
6. Do not share printed copies of graphics for anyone else's use but your own.
7. Do not redistribute graphics.
8. Do not use or display the Copyrighted Products on websites or other venues designed to induce or involving the sale, license or other distribution of “on demand” products, including postcards, mugs, t-shirts, posters and other items (this includes personal, custom designed websites, as well as sites such as, but not limited to: cafepress.com, ebay.com and etsy.com)
9. Do not resell sub-license, re-sell, rent, lend, assign, gift or otherwise transfer or distribute the Copyrighted Products or the rights granted under this Agreement.
10. Do not claim graphics as your own work.
11. Do not use graphics for business purposes.
12. Do not install and use the Copyrighted Products in more than one location at a time or post a copy of the Copyrighted Products on a network server or web server for use by other users.
13. Do not use or display the Copyrighted Products in an electronic format that enables it to be downloaded or distributed via mobile devices or shared in any social media, peer-to-peer or similar file sharing arrangement.
14. Do not use the Copyrighted Products for editorial purposes without including the following credit adjacent to the Copyrighted Products, © Pixelbooking, Inc, www.pixelbooking.com.
15. Do not use any part of the copyrighted products to create greeting cards, stationery, home decor, jewelry or any other merchandise for resale.
16. Do not incorporate the Copyrighted Products in any product that results in a re-distribution or re-use of the Copyrighted Products (such as electronic greeting card web sites, web templates and the like) or is otherwise made available in a manner such that a person can extract or access or reproduce the Copyrighted Products as an electronic file.
17. Do not not use any part of the copyrighted products to create any products for resale on e-Bay, etsy, or any other person/artist/site & call it your own work.
18. You may not use the Copyrighted Products in a fashion that is considered by pixelbooking (acting reasonably) as or under applicable law is considered pornographic, obscene, immoral, infringing, defamatory or libelous in nature, or that would be reasonably likely to bring any person or property reflected in the Copyrighted Products into disrepute.

Photographer License User Agreement

(3) WHAT YOU CAN DO.

By purchasing a Photographer’s License for each downloadable product, you are granted the following uses of these products:

1. You may use the products (flattened in a printed format) in your photography business for:
   1. marketing purposes for your own business
   2. press-printed designs for your clients (photo cards, announcements, rep cards, bookmarks, stickers, posters)
   3. photo albums for resale to your clients in a completed format
2. You must flatten products into a printed format. In other words, do not use, email or share a layered document or in any format in which the Copyrighted Products may be accessed, extracted or duplicated (flatten it before sending to print or sending to a client).
3. You are able to resize, change colors or add other graphics to the products for your photography use.
4. Only you are permitted to use the Copyrighted Products, You may install and use the Copyrighted Products in only one location at a time, although subject to the Prohibited Uses and the other terms of this Agreement, you are entitled to utilize the Permitted Uses an unlimited number of times. You may physically transfer the Copyrighted Products and its archives from one location to another, in which case you may use the Copyrighted Products at the new location instead. (4) HERE’S WHAT YOU CANNOT DO (Prohibited Uses):

1. Do not resell, redistribute or manipulate any of the copyrighted products in any way (applies to layered files, PNG files, ABR files).
2. Do not resell any part of the products to retailers, designers, or customers.
3. Do not claim the Copyrighted Products as your own work.
4. Do not use any part of the copyrighted products to create t-shirts, greeting cards, stationery, home decor, jewelry or any other merchandise.
5. Do not use any part of the copyrighted products to create any products for resale on e-Bay, etsy, cafe press, or any other person/artist/site & call it your own work.
6. You may not use the Copyrighted Products in a fashion that is considered by Pixelbooking (acting reasonably) as or under applicable law is considered pornographic, obscene, immoral, infringing, defamatory or libelous in nature, or that would be reasonably likely to bring any person or property reflected in the Copyrighted Products into disrepute.
